By Constanza Vieira BOGOTA, Jun 16 (IPS) -- Biopiracy could be a sticking point in the free trade negotiations that the United States is pursuing with three of the countries with greatest biodiversity in the world: Colombia, Ecuador and Peru. Making biopiracy a priority issue is the spokesman for the three Amazonian and Andean South American nations in talks on the proposed agreement's chapter on intellectual property, Luis Angel Madrid, an official and expert from Colombia's foreign trade ministry. The three are members of the Andean Community of Nations (CAN), which since 1969 has been working to create a common economic area along with Venezuela (which Washington did not invite to the trade treaty negotiations, presumably due to differences with the Hugo Chávez government), and Bolivia, which is expected to join the talks when they are farther along. The second of eight rounds of negotiations for the free trade agreement is meeting this week in the southeastern U.S. city of Atlanta, and intellectual property rights is one of the issues on the table. 'The United States has been patenting the biodiversity of the Andes in a practice that we do not hesitate to call biopiracy, and we are going to make it very clear (in the negotiations) that we don't like it,' Madrid told IPS. 'Biopiracy' is the illegal appropriation of biological resources or traditional knowledge, which often has been passed down through generations during millennia in indigenous communities. The draft text the negotiators are considering says in its eighth article that each country should allow patents for 'inventions' including plants and animals, and diagnostic, therapeutic and surgical procedures for treating humans or animals. 'The Andean regulations (under the CAN agreement) prohibits us from patenting plants and animals,' Madrid said of the text. As such, material that can be patented must be a human creation with some degree of invention and, above all, with some economic or industrial application. 'The chapter on intellectual property is offensive. (The U.S. negotiators) only want to extend the advantage they already have. In fact, the greatest emphasis has been placed on copyright,' especially in the chemical pharmaceutical area, said the ministry official. 'The United States isn't interested in negotiating (access to genetic resources) because it has already been accessing them unilaterally,' but Colombia 'wants to take the offensive on the biodiversity issue, which is the only one that is regulated by an (international legal) framework -- CAN's,' he added. CAN recognises the vast biological diversity of the Andean and Amazonian regions and their genetic resources as holding 'strategic value in the international context.' The biodiversity rules were adopted by the five-nation bloc in 1996 and take legal precedence over the national legislation of each country. They recognise the rights of indigenous, African-American and peasant farmer communities 'over their traditional knowledge, innovations and practices associated with genetic resources and their derivative products.' But they also establish national sovereignty over the genetic resources and their derivatives, a point that makes indigenous leaders uncomfortable, so they are seeking rights over both of them in their ancestral lands, where indigenous communities apply collective knowledge in the conservation and use of plant and animal species. In Madrid's opinion, 'the U.S. rules are not as precise as the Andean rules, and we are going to defend the Andean system for access to genetic resources.' The Colombian official spoke Friday with José Soria, secretary-general of the Organisation of Indigenous Peoples of the Colombian Amazon (OPIAC), in a first-ever meeting, convened by the Interior and Justice Ministry's directorate for minority groups, and attended by environmental authorities. IPS was the only news media present. Madrid told Soria, the only Indian in attendance, that the government wants 'the communities to be involved in the trade negotiations, so that there is a wary eye' on the process and to begin a dialogue afterwards that would be expanded to include the Afro-Colombians to 'hear opinions about issues that directly affect them.' The 90 indigenous groups in Colombia do not surpass two percent of the national population of 44 million; in Peru, the indigenous population constitutes 47 percent of the 26 million inhabitants; and in Ecuador, 43 percent of the population of 13 million is indigenous. In Colombia, there are more than a million people of African descent living in small, traditional communities, many of them living in the jungle environment along the coast. The Colombian constitution recognises indigenous state authority over some 31 million hectares, more than 27 percent of national territory. And a special law establishes the Afro-Colombian communities' collective ownership of around 800,000 hectares in the northwest department of Chocó, home to the world's highest concentration of biodiversity, according to experts. The U.S. proposed text is not completely confidential, but nor is it totally public. At the explicit request of the U.S. negotiators, its content is not available on the Internet and the governments that have been invited to participate in the talks have also been asked not to disseminate it in the mass media. But at the Colombian Ministry of Foreign Trade, the text is available but cumbersome to use: one could ostensibly copy the text, by hand, reading from a public computer terminal that is blocked from producing digital or print copies. 'In the text there is no attempt, for now, to appropriate anything. Access to genetic resources is not being negotiated and we are not negotiating traditional knowledge,' said Madrid. Colombian territory covers just one percent of the world's land surface, but it holds 10 percent of all species of flora and fauna, and is second in biological wealth only to Brazil, according to the Alexander von Humboldt Biological Resources Research Institute. Experts estimate that 38 percent of the country remains biologically unexplored. Colombia is the world leader in diversity of bird, flower, butterfly, lizard and frog species. According to critics of the trade treaty with the United States, clause B (referring to diagnostic, therapeutic and surgical procedures) could be a heavy blow that would hurt more than just the low-cost medicine industry. It might also lead to the appropriation of the knowledge accumulated over generations of systematic observation of the natural environment and passed down orally through the generations, in what Marceliano Guerrero, a traditional doctor of the Uitoto Indians of the Amazon, refers to as the 'oral principle'. Indigenous doctors and shamans receive training over the course of 20 to 35 years, and become the most respected members of their communities. That long dedication to study has yet to be recognised as comparable to the formal academic careers of doctors and professors. By observing the ripening process of certain fruits, some of these wise ones in the Amazon are able to forecast an outbreak of malaria months in advance, and thus are better able to protect their people from the disease, having them avoid consumption of certain animal fats and fruits. It remains to be seen whether traditional knowledge like this will be respected in the definitive version of the intellectual property chapter in the free trade treaty that Colombia, Ecuador and Peru are negotiating with the United States. EEUU-COLOMBIA ¿Libre comercio sin biopiratería? Constanza Vieira BOGOTA, 14 jun (IPS) - La biopiratería podría pasar al banquillo de los acusados en la negociación del tratado de libre comercio que Estados Unidos propone a tres de los países con mayor riqueza biológica del mundo: Colombia, Ecuador y Perú, a la vez andinos y amazónicos. Esa es la intención del portavoz de las tres naciones sudamericanas en la mesa que negocia el capítulo de propiedad intelectual del acuerdo, Luis Angel Madrid, funcionario y experto del Ministerio colombiano de Comercio Exterior. Los tres países forman parte de la Comunidad Andina de Naciones (CAN), que desde 1969 avanza hacia la creación de un área económica común, junto con Venezuela (no invitada por Washington a negociar, presumiblemente por diferencias con el gobierno de Hugo Chávez) y Bolivia, que se incorporaría a la negociación cuando esté más adelantada. La segunda ronda del total de ocho previstas para acordar el tratado sesiona esta semana en la ciudad estadounidense de Atlanta, y la propiedad intelectual es uno de 16 temas que se abordan en otras tantas mesas de negociación. "Estados Unidos ha venido patentando la biodiversidad andina en una práctica que no dudamos en calificar de biopiratería, y vamos a decirle claramente (en el marco de la negociación) que eso no nos gusta", dijo Madrid a IPS. La biopiratería es el usufructo ilegal de recursos genéticos y conocimientos tradicionales vinculados a ellos. El borrador que estudian los negociadores dice en su artículo octavo: "Cada país deberá permitir las patentes para las siguientes invenciones: a) plantas y animales; y b) procedimientos diagnósticos, terapéuticos y quirúrgicos para el tratamiento de humanos y animales". "La normativa andina (en el marco de la CAN) nos prohíbe patentar plantas y animales", comentó Madrid sobre este texto, revelado por el diario colombiano El Tiempo. Así, el material sujeto a patente debe ser una creación humana con algún grado de inventiva y, sobre todo, con aplicabilidad industrial. "El capítulo sobre propiedad intelectual es ofensivo. A (los estadounidenses) les importa profundizar la ventaja que tienen. De hecho, el mayor énfasis lo han puesto en el tema de derechos de autor", sobre todo en el área de la química farmacéutica, agregó Madrid. "A Estados Unidos no le interesa negociar (el acceso a los recursos genéticos) porque ya viene haciéndolo unilateralmente", pero Colombia "quiere ser ofensiva en el punto de la biodiversidad, que es el único tema que está reglamentado por un marco (jurídico supranacional), el de la CAN", añadió. La CAN reconoce como "un valor estratégico en el contexto internacional" la mega diversidad biológica en el área andina, una de las mayores del mundo, y los recursos genéticos. La normativa fue adoptada por el bloque andino en 1996 y tiene mayor jerarquía jurídica que las legislaciones nacionales de sus países miembros. Reconoce los derechos de las comunidades indígenas, afroamericanas y campesinas "sobre sus conocimientos, innovaciones y prácticas tradicionales asociados a los recursos genéticos y sus productos derivados". Sin embargo, establece la soberanía de la nación sobre los recursos y sus derivados, lo que incomoda al liderazgo indígena, que pide la titularidad de ambos en sus territorios ancestrales, donde las comunidades han aplicado el conocimiento colectivo en la conservación y aprovechamiento de las especies biológicas. Para Madrid "las normas estadounidenses no son tan precisas como las normas andinas, y vamos a defender el régimen andino sobre acceso a recursos genéticos". Madrid se reunió el viernes con José Soria, secretario general de la Organización de los Pueblos Indígenas del Amazonas Colombiano (Opiac), en un primer encuentro convocado por la Dirección de Etnias del Ministerio del Interior y de Justicia, con asistencia de autoridades ambientales. IPS fue el único medio de comunicación que presenció la reunión. Madrid manifestó a Soria, único indígena que asistió a la cita, el interés gubernamental de que "las comunidades se involucren en la negociación, que haya un ojo celoso que acompañe" el proceso y de iniciar un proceso de diálogo que posteriormente sería ampliado a los afrocolombianos, con el fin de "recibir opiniones sobre aquello que les atañe directamente". El objetivo es "eliminar el ruido" que acompaña la negociación del tratado de libre comercio, sostuvo el director de Etnias, Jesús Ramírez. Las 90 etnias que habitan el territorio colombiano no superan dos por ciento de los 44 millones de habitantes, mientras en Perú la población indígena constituye 47 por ciento de sus 26 millones de habitantes, y en Ecuador, 43 por ciento de un total de más de 13 millones de personas. Poco más de un millón de afrocolombianos habita en pequeñas comunidades tradicionales, muchas de ellas totalmente adaptadas al medio selvático costero. La Constitución colombiana reconoce la autoridad estatal indígena sobre casi 31 millones de hectáreas, más del 27 por ciento del territorio nacional. Además, la Ley de Negritudes establece la propiedad colectiva de las comunidades negras sobre cerca de 800.000 hectáreas del noroccidental departamento del Chocó, que concentra la mayor riqueza biológica del mundo, según expertos. El texto de la propuesta estadounidense no es totalmente secreto, pero tampoco es totalmente público. Por solicitud expresa de los negociadores estadounidenses, su contenido no está disponible en Internet y los gobiernos que han sido invitados a pactar el acuerdo tampoco deben darlo a conocer masivamente en la presente etapa. Sin embargo, en la sede del Ministerio de Comercio Exterior es posible copiar el texto, en forma manuscrita, desde la pantalla de un computador público no habilitado para extraer copias digitales. "En el texto no hay por ahora ningún intento de apropiarse de nada. No se está negociando el acceso a los recursos genéticos y no estamos negociando el conocimiento tradicional", subrayó Madrid. Colombia, con una superficie terrestre que no alcanza a uno por ciento del área continental mundial, posee cerca de 10 por ciento de todas las especies de fauna y flora, y ocupa entonces el segundo lugar en riqueza biológica después de Brasil, según el Instituto de Investigación de Recursos Biológicos Alexander von Humboldt. Expertos estiman que 38 por ciento del territorio permanece aún inexplorado por la investigación biológica. Colombia tiene además 1.800 especies de aves, lo que le da el primer lugar en diversidad mundial de estas especies. Tres de ellas fueron descubiertas recientemente. El país también cuenta con la mayor diversidad planetaria de flores silvestres, mariposas, lagartos y ranas. Para los críticos del tratado con Estados Unidos el inciso b del borrador (referido a procedimientos diagnósticos, terapéuticos y quirúrgicos) podría golpear no sólo a la industria de medicamentos de bajo precio. También podría robar o ignorar el conocimiento acumulado por generaciones de observación sistemática del comportamiento del entorno a través del "principio oral", como lo llama Marceliano Guerrero, médico tradicional de los indios uitoto del Amazonas. Los chamanes y médicos tradicionales indígenas se preparan, según la etnia, durante 20 a 35 años para ejercer como tales, tras lo cual se convierten en las autoridades más respetadas y acatadas por sus comunidades. Esa larga entrega al estudio no ha sido equiparada hasta ahora con los grados académicos de médicos y profesores. Mediante la observación de los tiempos de maduración de ciertos frutos, los sabios de la selva amazónica son capaces de prever con meses de anticipación el advenimiento de una epidemia de malaria, y preservar de la enfermedad a su gente, sometiéndola a prolongadas dietas exentas de ciertas grasas animales y vegetales y de determinadas frutas. Habrá que esperar para ver si esfuerzos de ingenio colectivo como éste son respetados en el capítulo definitivo sobre propiedad intelectual del tratado de libre comercio.
