BN à Paris Le mardi 27 juin 2000 Washington de notre correspondant Deux équipes ont annoncé hier à la Maison Blanche qu'elles avaient parallèlement déchiffré la carte du génome humain, une réussite technologique comparable à la conquête de la Lune. Mettant fin pour l'occasion à leurs rivalités, le Human Genome Project - un consortium public international de laboratoires de recherche, conduit par les Etats-Unis - et Celera - une entreprise privée américaine - assurent avoir découvert séparément la quasi-totalité du texte génétique humain. Lyrique, Bill Clinton a comparé cette découverte à la carte du ciel de Galilée. «Aujourd'hui, nous apprenons le langage qui a permis à Dieu de créer la vie.» Craig Venter, le président de Celera, a parlé de «jour historique dans les 100 000 ans de l'histoire de l'humanité»: «Pour la première fois, l'espèce humaine peut lire les lettres de son texte génétique.» A peine moins triomphant, Francis Collins, directeur du projet public, célébrait «la révélation du livre de la vie». Cette cérémonie commune à la Maison Blanche met fin à des mois de concurrence entre les deux hommes et les deux clans qu'ils représentent (Libération d'hier). Bill Clinton, lui-même, était intervenu pour que les deux chercheurs fassent la paix et puissent ensemble présenter le résultat de leurs travaux. Au cours d'une conférence de presse commune à Washington, les deux hommes se sont solennellement serré la main devant des centaines de journalistes. Et des observateurs n'ont pas hésité à évoquer le souvenir de la poignée de main Arafat-Rabin. «Le travail commence.» Craig Venter, qui se présente volontiers comme un iconoclaste de la biologie, a souligné les divergences entre les travaux de son équipe et ceux du consortium public. Entièrement financée par le secteur privé, l'entreprise a obtenu ses résultats en neuf mois, alors que le consortium public travaillait depuis quinze ans sur le code génétique. Celera a employé une méthode non conventionnelle de séquençage, appuyée par une batterie d'ordinateurs extrêmement puissants, plus rapides que les machines du consortium. Selon Venter, ses équipes ont ainsi pu séquencer l'ADN de cinq hommes et femmes, blancs, noirs et hispaniques, «pour respecter la diversité de l'Amérique». «Rien ne permet de discerner leurs ethnies», a répété Venter, dont le propre ADN aurait été décrypté par Celera. Les méthodes à la hussarde de Craig Venter, un ancien médecin du Viêt-nam qui sait faire sa publicité, ont valu à Celera une solide hostilité de la communauté scientifique. L'entreprise privée a affirmé qu'elle diffusera dès septembre ses cartes génétiques sur son site Internet. Celera obtiendra des royalties si des spécialités pharmaceutiques fondées sur ces découvertes sont commercialisées. En revanche, l'accès aux cartes du consortium public est totalement libre. Selon Craig Venter, ses découvertes pourraient ainsi soigner définitivement le cancer. Plus prudent, Francis Collins a souligné, que «le vrai travail commence...» «Nouvelle ère». L'événement scientifique a été l'occasion d'une célébration internationale. La première annonce de cette performance, fruit du travail de 18 laboratoires dans le monde, est venue du Japon, avantagé par le décalage horaire. Le ministre japonais de la Recherche a salué ce pas «très significatif pour l'histoire scientifique et humaine». Quelques heures plus tard, Tony Blair, vantait cette «révolution» scientifique, «le premier triomphe technologique du XXIe siècle», qui fait entrer «l'humanité dans une nouvelle ère». Puis ce fut à Bill Clinton de conclure la ronde des grands de ce monde. Il propose que les Etats-Unis et tous les autres pays qui le souhaitent ?uvrent ensemble pour définir les critères communs en matière d'exploitation du décryptage du génome. «Je pense que cela serait une très bonne chose si tous ceux qui veulent travailler avec nous pouvaient mener un nouveau projet en commun [...], pour traiter de ses implications légales, sociales et éthiques.» Tout un programme. LE MINISTRE DE LA RECHERCHE REJETTE LES BREVETS SUR LES SEQUENCES D'ADN: «PERSONNE N'EST PROPRIETAIRE D'UN GENE» Recueilli par Corinne Bensimon C'est la victoire de ceux qui voulaient que le savoir reste libre», a déclaré hier le ministre français de la Recherche, Roger-Gérard Schwartzenberg. Ainsi a-t-il qualifié, avec des accents gaulliens, la performance du consortium de laboratoires publics, talonné par la société privée Celera, dans la course à la séquence de l'ADN humain. Dans cette bataille, la contribution de la France, qui avait réalisé les cartes indispensables à ce travail de séquençage, a pourtant été modeste par rapport à celle des «alliés» américains et britanniques: sous la direction du généticien Jean Weissenbach, le Génoscope a séquencé - en l'espace d'un an et demi - la majeure partie du chromosome 14, qui représente seulement 3% du génome humain. Dans ce contexte de disparité de production, le partage de la connaissance de l'ADN est crucial pour le progrès de la science. Va-t-on vers une entente internationale sur les brevets en génétique? Entretien avec le ministre de la Recherche. Le président Clinton a appelé à une conférence sur l'éthique dans le domaine de la génétique. Souhaitez-vous également une telle réunion? Avant même cette déclaration, j'ai réuni à Bordeaux, jeudi et vendredi, des biologistes et des juristes de douze pays, dont des spécialistes américains pour réfléchir ensemble à des principes éthiques et à des règles juridiques qui seraient harmonisés au plan international pour accompagner et réguler ces progrès de la science. Le séquençage a soulevé la question de la propriété intellectuelle. Comment envisagez-vous la frontière, en biologie, entre brevetable et non brevetable? Il existe au niveau des Etats un consensus, au moins sur les grandes lignes. C'est ce qui est apparu lors de la réunion semestrielle des ministres de la Recherche du G8 qui s'est tenue ce week-end à Bordeaux, et à laquelle étaient invités, à l'initiative de la France, le Mexique, le Brésil et l'Inde. Et le problème des brevets en génétique était l'un des thèmes majeurs. Il en est ressorti que nous sommes tous d'accord pour que les séquences d'ADN, qui sont des données fondamentales, ne doivent pas être brevetées. Ce sont des découvertes d'objets existants dans la nature, non des inventions. Cette position de principe est importante. Car ce n'est pas celle défendue par Celera et quelques autres sociétés engagées dans le décryptage du génome humain. Ce non aux brevets sur les séquences d'ADN signifie-t-il un non aux brevets sur les gènes? Les gènes en eux-mêmes ne sauraient être considérés comme des inventions. Or, les brevets doivent être réservés aux inventions qui ont un caractère de nouveauté et dont l'application industrielle est prouvée. C'est ce que prévoit le droit européen des brevets. Le droit américain parle simplement d'«utilité», ce qui permet d'accorder des brevets bien plus facilement. Le concept d'«application industrielle» est plus exigeant. Il va falloir se mettre d'accord sur cette question avec les Etats-Unis, pour éviter des dérives. Le problème, c'est qu'il y a un certain laxisme aux Etats-Unis dans la façon d'accorder les brevets. La directive européenne sur les brevets en biotechnologie vous semble-t-elle poser problème? Elle proscrit clairement les brevets sur les séquences brutes, et elle exige d'identifier la fonction d'un gène et de définir son application thérapeutique ou diagnostique. Mais pour éviter toute dérive, il est possible que nous demandions à Bruxelles une interprétation de cette directive afin que la barre entre découverte et invention soit précisée. Quel est l'enjeu de l'encadrement des brevets sur le vivant? On parle beaucoup de risque de privatisation du patrimoine de l'homme, du vivant. Le problème n'est pas là. Personne ne peut être propriétaire d'un gène, cela n'a pas de réalité. En revanche, ce qui menaçait, c'est la privatisation de connaissances fondamentales pour l'avenir de la biologie et de la médecine. Celera, par son dynamisme, a incidemment réveillé les bailleurs de fonds de la recherche publique (essentiellement américains et britanniques), qui ont alors décidé d'accélérer la cadence. Heureusement, grâce aux organismes publics de recherche, dont le Centre national de séquençage français, nous avons échappé à une menace de confiscation du savoir. BN in Paris Tuesday 27 June 2000 Washington, from our correspondent Two teams announced yesterday at the White House that they deciphered the map of the human genome in parallel, a technological feat comparable to the conquest of the Moon. Putting an end to their rivalries, the Human Genome Project - an international public consortium of research laboratories, led by the United States - and Celera - a private American company - assured everyone that they separately discovered the near totality of the human genetic text. In lyric form, Bill Clinton compared this discovery to Galileo's map of the sky. "Today, we are learning the language that allowed God to create life." Craig Venter, the Director of Celera, talked about this "historical day in the 100,000 years of human history. For the first time, the human species can read the letters of its own text." Hardly less triumphant, Francis Collins, head of the public project, celebrated "the revelation of the book of life." This joint ceremony at the White House puts an end to months of competition between the two men and the two clans which they represent (Libération of yesterday). Bill Clinton himself intervened so that the two researchers make peace and present together the results of their work. During a joint press conference in Washington, the two men solemnly shook hands before hundreds of journalists. And some observers didn't hesitate to evoke memories of the handshake between Arafat and Rabin. The private company affirmed that its own genetic maps will be available on the Internet by September. Celera will claim royalties from any commercial pharmaceutical application of its discoveries. In contrast, access to the maps produced by the public consortium will be totally free. According to Craig Venter, his discoveries could definitively cure cancer. More prudent, Francis Collins stressed that "the real work is starting". New era The scientific event was an occasion of international celebration. The first announcement of the accomplishment, the fruit of work done in 18 laboratories across the world, came from Japan, because of the time zone. The Japanese Research Minister saluted this step as "very significant for scientific and human history." A few hours later, Tony Blair boasted about this scientific "revolution", "the first technological triumph of the 21st Century." Then it was Bill Clinton's turn among the leaders of the world. He proposed that the United States and any other countries so wishing could work together to define common criteria for the exploitation of the human map. "I think it would be a very good thing if all those who want to work with us could carry out a joint project...to deal with the legal, social and ethical implications." A whole programme. THE MINISTER OF RESEARCH REJECTS PATENTS ON DNA SEQUENCES. "NO ONE CAN OWN A GENE" Interview by Corinne Bensimon "It's the victory of those who wanted knowledge to remain free", declared yesterday the French Research Minister, Roger-Gérard Schwartzenberg. Or so he qualified, in Gaullist fashion, the performance of the public consortium, followed by the private company Celera, in the race to sequence the human genome. In this battle, the contribution of France, which put together maps that were indispensable for the sequencing work, was nevertheless modest compared to that of its American and British "allies". Under the direction of geneticist Jean Weissenbach, Génoscope sequenced - in a year and a half - the major part of chromosome 14, which represents 3% of the human genome. In this very uneven context of who produces what, the sharing of knowledge about DNA is crucial for the advancement of science. Are we heading towards and international agreement on patenting in genetics? An interview with the Minister of Research. President Clinton has called for a conference on ethics in the field of genetics. Do you also wish for such a meeting? Before his statement, I brought together in Bordeaux, last Thursday and Friday, biologists and jurists from 12 countries, of which American specialists, to reflect together on the ethical principles and legal rules which would be harmonised at the international level to accompany and regulate the progress of this science. The sequencing has raised the question of intellectual property. How do you see the borderline in biology between what is patentable and what is not patentable? Among States there is a consensus, at least in the broad strokes. This is what appeared during the quarterly meeting of Research Ministers of the G8 which was held in Bordeaux this weekend, and to which were invited, on the initiative of France, Mexico, Brazil, [China] and India. The problem of patenting in genetics was one of the major themes. It came out that we are all in agreement that DNA sequences - the fundamental data - must not be patented. They are discoveries of objects which exist in nature, not inventions. This position of principle is important. Because it's not the one defended by Celera and a few other companies engaged in deciphering the human genome. This "no" to patents on DNA sequences, does it mean "no" to patents on genes? Genes themselves cannot be considered inventions. Patents must be reserved for inventions which are new and whose industrial application has been proven. This is what European patent law says. American law only talks about "usefulness", which allows for a much looser patenting policy. The concept of "industrial application" is more demanding. It will be necessary to reach agreement on this issue with the United States to avoid any mishaps. The problem is that there is a certain laxism in the way patents are granted in the United States. Does the European directive on patenting in biotechnology pose problems, in your view? It clearly outlaws patents on raw sequences while it demands the identification of the function of a gene as well as the definition of a gene's therapeutic or diagnostic application. But to avoid any problems, it is possible that we will request Brussels to issue an interpretation of the directive in order to ensure that the borderline between discoveries and inventions is precise. What is at stake with the whole framework of patents on life forms? People talk a lot about the risk of privatising the heritage of man, privatising life. The problem is not there. No one can own a gene, that has no reality. On the other hand, what has been threatening us is the privatisation of knowledge that is fundamental for the future of biology and medicine. Celera, because of its dynamism, unintendedly woke up the public research funding agencies (essentially American and British) which then speeded up the work. Thankfully, it's because of the public research institutes, of which the French National Sequencing Centre, that we were able to prevent the threat that this knowledge would be confiscated. It's a victory of ethics.
