Notas de Prensa del Indecopi PUBLICAN PROPUESTA DE RÉGIMEN PARA LA PROTECCIÓN DE CONOCIMIENTOS TRADICIONALES Se creará un nuevo registro de propiedad intelectual en el Indecopi para dar valor comercial a los conocimientos tradicionales. Documento ingresa a debate público hasta el 20 de diciembre. El Indecopi, conjuntamente con los ministerios de Agricultura, Promudeh y Pesquería, publicó hoy en el diario oficial El Peruano un documento de Trabajo que contiene propuestas legislativas para crear un Régimen de Protección de los Conocimientos Colectivos de los Pueblos Indígenas y un Régimen de Acceso a los Recursos Genéticos. Ambas propuestas permitirán dar un valor intelectual a los conocimientos de las miles de comunidades existentes en el país y de los recursos genéticos y, por tanto, la posibilidad que obtener un beneficio económico con la utilización comercial de estos recursos. Ambos proyectos son sometidos a consideración del público hasta el 20 de diciembre, periodo en el que se recogerán los comentarios de los interesados a fin de ser incoporados en un texto final que será enviado al Consejo de Ministros y posteriormente al Congreso de la República. Cabe indicar que dicho documento de trabajo fue preparado por un equipo técnico del Indecopi en base a un proceso de consulta que involucró el aporte de 16 instituciones públicas y privadas, incluidas las propias comunidades. Proyecto sobre comunidades Uno de los objetivos de este proyecto es la creación de nuevos derechos de propiedad intelectual, que enmarcándose dentro de los tratados internacionales suscritos por el Perú, generen la confianza necesaria para que los miles de conocimientos tradicionales de los pueblos indígenas sean incorporados a un registro y se reconozcan sus derechos cuando éstos sean aprovechados comercialmente por los investigadores o laboratorios farmaceúticos nacionales o extranjeros. Adicionalmente, la creación de nuevos derechos de propiedad intelectual mediante el registro permitirá que su aprovechamiento comercial no sólo beneficien al pueblo titular del derecho, sino a todas las comunidades. Para ello, el documento propone la creación de un Fondo para el Desarrollo de los Pueblos Indígenas (FONDEPI). Este fondo será administrado por las propias comunidades bajo la supervisión del Indecopi y su finalidad será contribuir al desarrollo integral de los pueblos indígenas a través del financiamiento de proyectos. Sus recursos provendrán de un porcentaje de las ventas resultantes del aprovechamiento comercial de los conocimientos. Proyecto sobre Recursos Genéticos En este tema, se propone regular el acceso a la información genética que contiene nuestros recursos para lo cual se establece un procedimiento administrativo de acceso. El objetivo es permitir una participación justa del Estado en los beneficios derivados del acceso a estos recursos que son patrimonio del Estado. En el documento se propone además la creación de la Comisión Nacional de Recursos Genéticos (CONARGE), como autoridad competente, para otorgar la autorización de acceso a estos recursos y, de ser el caso, establecer sanciones a quienes accedan ilegalmente al mismo. Asimismo, el documento propone la creación de un Fondo de Conservación y Desarrollo de Recursos Genéticos (FONDEREG) el mismo que precisamente promoverá la preservación y aprovechamiento comercial de estos recursos, dentro del marco legal establecido. The proposal is submitted for public debate until 20 December. Indecopi, together with the Ministries of Agriculture, Promudeh [Ministry for the Promotion of Women and Human Development] and Fishing, published today in the official journal, The Peruvian, a working document containing legislative proposals to create a Regime for the Protection of Collective Knowledge of Indigenous Peoples and a Regime on Access to Genetic Resources. Both proposals grant intellectual value to the knowledge of thousands of communities existing in the country and to genetic resources, thereby creating the possibility to secure economic benefits from the commercial use of these resources. Both proposals are hereby submitted to the public for discussion until 20 December. Over this period, comments of interested parties will be collected and incorporated into a final text which will be sent to the Council of Ministers and, finally, to Congress. The working document was prepared by a technical group from Indecopi following a consultative process in which 16 public and private institutions participated, including communities themselves. Project on communities One of the objectives of this project is the creation of new intellectual property rights (IPR) in the framework of international treaties to which Peru is committed. Through these new rights, the traditional knowledge of thousands of indigenous peoples will be registered and therefore can be recognised whenever it is used commercially by researchers or pharmaceutical laboratories, be they national or foreign. Additionally, the creation of this new IPR registry will allow not only specifically entitled groups to benefit from the commercial use of their traditional knowledge, but all communities. For this, the document proposes the establishment of an Indigenous Peoples' Development Fund (FONDEPI). The Fund will be administered by the communities themselves under the supervision of Indecopi and will support the development of indigenous peoples by financing projects. A percentage of all sales resulting from the commercial use of traditional knowledge will go the Fund. Project on genetic resources Access to genetic information will be regulated through an administrative procedure. The objective is to give the State a fair share of the benefits derived from access to these resources, which are the heritage of the State. The working document proposes the creation of a National Committee on Genetic Resources (CONARGE) as competent authority to grant access to genetic resources and to sanction illegal activities in this respect. The document also proposes the creation of a Genetic Resources Conservation and Development Fund (FONDEREG) which shall promote the conservation and commercial use of these resources, within the established legal framework.
