Public letter in defense of the community of Cajueiro (Brazil)

PUBLIC LETTER IN DEFENSE OF THE COMMUNITY OF CAJUEIRO
THE TRACTORS ARE READY TO DESTROY THE CAJUEIRO COMMUNITY IN SÃO LUÍS DE MARANHÃO!


We express our indignation at the threat of imminent forced eviction of residents of the community of Cajueiro for the construction of a private port of the company WPR São Luís Gestão de Portos e Terminais Ltda (currently TUP Porto São Luís S/A) - in São Luís de Maranhão, in Brazil - in a large eviction operation scheduled by the Maranhão military police to occur at any time from the morning of this Monday, 08.12.2019.

We denounce the existence of numerous arbitrariness that subsidize the measures ordered against the traditional population of Cajueiro, with the intention of destroying their homes, compromising their lives and producing invaluable consequences for the environmental and cultural heritage of the island of São Luís. If the port activities are concretized, they will affect mangroves and important areas for traditional farming and fishing throughout the region - already affected by other companies and ports - and will also damage the Terreiro do Egito, the first Terreiro de Mina of Maranhão, a religious, cultural and archaeological heritage for religions of African origin.

More than 180 military police officers are being mobilized for the tragic eviction of around 28 families, eliminating agricultural and fruit/nut collection areas and disallowing fishing, without compensation or resettlement, as they are considered invaders. A second planned dispossession act is based on an expropriation decree under justification of public utility and is to be carried out against six families, considered to be long living in the locality. The sequences of acts of expropriation against the families of that community shall still be extended, reaching 80 more families, in order to build the access route to the port terminal.

The site of Cajueiro or the town of Cajueiro or Bom Jesus do Cajual, as it was known, consists of five small nuclei called Parnauaçu, Andirobal, Guarimanduba, Morro do Egito and Cajueiro. Part of its territory (Parnauaçu, which is exactly where the port is intended to be built) is also within the perimeter of the Tauá-Mirim Collection Reserve (RESEX). The RESEX, recognized by the traditional communities of the rural areas of São Luís, has already been studied and delimited by the public institution responsible for the environmentally protected areas in Brazil (ICMBio), but this was never decreed by the federal government, due to the economic interests that fall upon the region. There is a sentence that protects the inhabitants of the RESEX against acts of dispossession, in the public civil action 0036138-02.2013.4.01.3700 (8th Federal Court of São Luís-MA) presented by the Federal Prosecutor's Office, which is being ignored.

Since 2014, a consortium of companies has been trying to build this private port in the community of Cajueiro. According to Correio Brasiliense newspaper (03.18.2018), 51% of the consortium's total stake belongs to China Communications Construction Company (CCCC), the largest infrastructure company in the Asian country. Lyon Capital owns 20%, WPR owns 24% and the rest belongs to other shareholders. Its objective is to export millions of tons of soybeans and corn to Europe and China. Therefore, it joins other enterprises in the Cerrado - the most biodiverse savanna in the world that covers Central Brazil - that require an exit by sea to the international market, as is the case of monoculture plantations in the agricultural frontier of the Cerrado – the so-called MATOPIBA. Composing the “MA” of the acronym that involves areas of other three states (Tocantins, Piauí and Bahia), the state of Maranhão reinforces a policy of becoming an export corridor for the MATOPIBA, to the detriment of its people and its history.

The business consortium has used several illegal strategies since 2014: arbitrary destruction of homes on Christmas Eve 2014; cooptation and demobilization of residents; use of private militias; impediment to free movement on public roads; deforestation; grounding of mangroves and streams; among others. Before the aggressions of the company to the possession of the residents of Cajueiro, the Office of the Public Defender of the State, in 2014, presented a Public Civil Action in its defense (ACP No. 46221- 97.2014.8.10.0001 – Collective and Diffuse Interest Court of São Luís - MA), having obtained a resolution that prohibits the port company from any act that prevents the free exercise of possession by the residents of Cajueiro. This ruling is still in force, but the company and the Government of Maranhão are trying to silence its existence.

The eviction decision that they now seek to comply, therefore, conflicts with an ACP decision that protects the tenure of the Cajueiro population over their territory. The impending forced eviction operation comes from an action moved in 2014 by the port company against the Union of Residents of Cajueiro. In July 2019, a court order was granted against the association. Although there are residents affected by the decision that are not even associated with it (which excludes their right to defense) and even if there is a judicial decision in conflict, the Government of Maranhão intends to carry out the eviction in a surprise operation without clarifying the exact day it will occur, causing a climate of terror among residents.

In the Court of Justice of Maranhão there are appeals to address these and other serious illegalities, but the economic power of the company has obtained support even from the Department of Human Rights of the State so that the eviction operation is carried out immediately, to create an accomplished and irreversible fact: the destruction of the Community of Cajueiro.

Therefore, we demand that the Government of Maranhão suspend, as a matter of urgency, the eviction operation scheduled to be carried out at any time from the morning of Monday, August 12, 2019, so that all existing aspects in pending judicial appeals can be clarified before the Court of the State of Maranhão.
